Terms and conditions for using Naits Points

1. Accumulation of points:
   Naits Points are only accumulated on purchases made through the official Nait Nait website and in accordance with the conditions in force at any given time.

2. Use of points:
   The points accumulated can be redeemed as a discount on future purchases, according to the equivalent value established in the program.

3. Not valid in conjunction with other promotions:
   The Naits Points Redemption It is not compatible with other discounts, promotional codes, special offers or current promotions , including Black Friday, sales, temporary campaigns or other similar benefits.

4. Discount application:
   The discount derived from Naits Points will only be applied to the price of the products, and is not valid for shipping costs or other additional services.

5. Program modifications:
   Nait Nait reserves the right to modify, temporarily suspend or cancel the Naits Points program at any time, informing users in advance through official channels.

6. Fraud or misuse:
   In case of detecting fraudulent or improper use of the program, Nait Nait may cancel the points obtained and take the corresponding measures.

DRAWINGS:

1. IDENTIFICATION OF THE PROMOTION ORGANIZER

 This draw is organized by the company NAIT NAIT, SOCIEDAD LIMITADA (hereinafter, Nait Nait, SL ), with Tax Identification Number: B-90.311.911 and registered address for notification purposes in Seville, at Avenida de Cádiz Nº9, SEVILLE (41004); with contact telephone number: 634 76 27 58 and email address: info@naitnait.com

2. PURPOSE OF THE PROMOTION

Nait Nait SL will carry out the raffles (hereinafter, the PROMOTIONS) and they will take place on the Instagram account of @naitnaitkids, in accordance with the provisions of these terms and conditions.

3. TERRITORIAL AND TEMPORAL SCOPE OF THE PROMOTION

3.1. The PROMOTIONS will be carried out within the Spanish State, only Peninsula Spain.

3.2. The promotional period is set in each of the posts made.

4. REQUIREMENTS AND HOW TO PARTICIPATE

4.1. Be a natural person over 18 years of age, resident in Spain.

4.2. Participate in the contest through the participant's real, active and personal Instagram account, which cannot be considered to have been created with the sole intention of participating in the PROMOTION.

Only accounts that meet the following characteristics will be considered valid for participation:

- The user must have a profile picture designated by themselves (it does not have to be a personal photo).

- You must have at least one photograph/post published on your profile since its creation.

An account will be considered to have been created with the sole intention of participating in the promotion when it has been opened after the publication of the promotion and does not meet the stated requirements.

4.3. It will be necessary to comply with the requirements indicated.

4.4. Each participant may participate as many times as they wish, from a single account or profile or from several, provided they meet the requirements set out above regarding the conditions of account validity.

5. FREE OF CHARGE

Participation in the PROMOTION is FREE .

6. PROMOTION PRIZES

6.1. The winner who, according to the participation criteria, and once the validity of the draw has ended, is/are the winner(s), will be entitled to receive the prize indicated in the publication.

6.2. The draw will be carried out through an application designed for this purpose.

6.3. The prize obtained, if any, will not be exchangeable or redeemable for its cash value or for another alternative prize.

Nait Nait, SL will cover the shipping costs once only to the address indicated by the winner under the terms expressed in section 7.1.

6.4. Participation in the draw implies acceptance and submission to the terms of participation set out in these legal bases by the participant, without being able to disregard what is stated herein.

7. NOTIFICATION TO THE WINNERS  

7.1. The winner will be informed directly via Instagram direct message, within SEVEN (7) business days (Monday to Friday) after the draw's end date.

Once the communication indicated in the previous section has been made, the prize winner must respond via the same method within a maximum period of TWO (2) business days (Monday to Friday) after the date of sending said communication, stating the following:

- That he /she expressly accepts the announced prize and the terms and conditions for its delivery provided for in these rules.

Failure to accept the prize and the terms and conditions for its delivery constitutes a waiver . If this is not stated in the reply message, Nait Nait, SL may require the prize winner to clarify this matter within the aforementioned timeframe.

- For the purposes set out in Condition 9 of these rules, you must provide a photograph in which only the prize winner appears and which complies with Instagram's terms and conditions for publication; or, otherwise, expressly authorize Nait Nait, SL to use the photograph that appears on your profile, under the terms set out in these rules.

Failure to comply with this requirement will result in forfeiture of the prize and exclusion from the draw. If this is not stated in the reply message, Nait Nait, SL may require the winner to clarify this matter within the aforementioned timeframe.

- Provide a copy of your national identity document (DNI) or equivalent title for foreign persons residing in Spain, in order to obtain the following personal data: Name and surnames, DNI and age.

- Provide an address within the territory of the Spanish State (Peninsula, Ceuta, Melilla, Balearic Islands and Canary Islands) to which the prize can be sent; a contact email address and mobile phone number.

If within the indicated period the prize winner or, where applicable, the alternate, does not respond to the communication made by Nait Nait, SL, it will be understood that they withdraw from the draw, and the prize will be passed to the next alternate on the draw list.

7.2. In the event that one or more prizes are not accepted and are considered withdrawn until the number of substitutes is exhausted, the prize in question will be declared void, and Nait Nait, SL will be exonerated from any obligation or responsibility.

8. RESERVATIONS AND LIMITATIONS

8.1. Nait Nait, SL., is exempt from all liability in case of malfunction of electronic communication networks that prevent the normal development of the promotion due to causes beyond its control and especially due to external acts of bad faith.

8.2. Any abusive or fraudulent use by users will result in the participant's disqualification from the PROMOTION. If such misuse of the application (with or without fraudulent intent) causes it to malfunction, Nait Nait SL will be exempt from all liability and may cancel the promotion.

8.3. Similarly, it will be understood, by way of example but not limitation, that abuse or fraud occurs when a participant participates in the promotion using a false account or third-party identities without their consent.

8.4 . Nait Nait is not responsible for any losses, damages, delays or any other circumstances attributable to third parties that may affect participation in this PROMOTION.

8.5 . Nait Nait is not responsible for any inappropriate or offensive content that users may upload at their own risk.

8.6. The discovery of any of these circumstances during the PROMOTION will result in automatic disqualification and prohibition from participating in the contest, as well as the loss of the prize if it has been awarded.

8.7. Nait Nait is exempt from any responsibility in the event of any error in the data provided by the participants themselves that prevents their identification.

8.8. The awarding of the Prize is personal and non-transferable .

The prizes are subject to these terms and conditions and cannot be exchanged, in whole or in part, for cash. Prizes are not subject to change, alteration, or compensation at the winners' request.

If the winner declines the prize, no alternative will be offered. Its sale or transfer is strictly prohibited.

8.9. Providing the winners' personal data is mandatory for the administration of the Prize. Any false communication of personal data will entitle the organizers of this draw to disqualify the winner and dispose of the corresponding prize, under the terms expressed herein.

8.10. Nait Nait reserves the right to make changes that contribute to the successful completion of the DRAW when there is just cause or reasons of force majeure that prevent it from being carried out in the manner described in these terms and conditions.

8.11. That Instagram is fully exonerated from any liability arising from this raffle on the part of each participant.

8.12. The winner is responsible for obtaining any necessary permission or consent for the enjoyment of the prize and for any incident that may occur during the prize.

Similarly, Nait Nait, SL will not be responsible for any damages, both personal and financial , suffered by the winners as a result of enjoying the prize, including compensation of any nature and/or kind, expenses, costs (with express inclusion of lawyers' and solicitors' fees).

8.13. Nait Nait, SL is expressly authorized to postpone, shorten, extend, modify, cancel or suspend the draw as a result of force majeure causes beyond its control, undertaking to inform the participants of this circumstance as soon as possible.

8.14. Nait Nait is exempt from any liability in the event of providing personal data, such as name, personal or banking details, to fraudulent accounts unrelated to Nait Nait. @naitnaitkids

Similarly, Nait Nait, SL is expressly authorized to resolve any contingency not foreseen in these legal terms and conditions, provided that it does not involve a substantial change to the terms and conditions of the draw or impair the rights of consumers and users or violate regulations on the protection of personal data.

9. ASSIGNMENT OF IMAGE RIGHTS AND/OR INTELLECTUAL PROPERTY RIGHTS OF THE AWARD WINNER

9.1. Acceptance of the prize, under the terms expressed in Condition 7.1., will entail the AUTHORIZATION to Nait Nait, SL by the prize winner to reproduce, use and disseminate their username , their account and their profile picture or that provided by them, in any advertising and/or promotional activity related to this PROMOTION, all in any medium (including, but not limited to, exploitation through the Internet and Social Networks) without such activities conferring any right to remuneration or benefit, without prejudice to the delivery of the prize obtained in accordance with these terms.

9.2. Failure to provide the authorization referred to in Condition 9.1 will result in the waiver of the prize obtained and exclusion from the draw, proceeding in accordance with the provisions of Condition 7.1.

10. PROCESSING OF PERSONAL DATA

10.1. The personal information provided by participants and prize winners will be treated in accordance with the highest standards of confidentiality and in compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights.

Nait Nait, SL will be responsible for processing this information. For this purpose, it will be incorporated into the Register of Processing Activities owned by Nait Nait, SL for processing related to participation in this draw, as well as for contacting the winners and alternates.

10.2. Terms of use of personal data:

Purpose of processing personal data. The collection and processing of personal data has the following purpose:

- Manage the PROMOTION regulated in these terms and conditions.

- The delivery and acceptance of the prize by the participants and prize winners.

- The shipment of the prize packs.

The personal data collected and processed are the data necessary for sending the packs and delivering the prizes drawn: name / surname / full home address / email address / telephone number.

Recipients: Access to personal data and information collected in the context of the organization and holding of the draw will only be granted to a specific number of duly identified persons, without prejudice to its possible transmission to the bodies and entities in charge of the tasks of monitoring, control or inspection of compliance with the obligations derived from the organization of this draw.

Data retention: The data controller will only retain the data when it is necessary to carry out follow-up actions regarding the act, taking into account the purpose of the processing of personal data.

The user may exercise the rights of access, rectification, erasure and other rights that can be consulted in the additional and detailed information in our privacy policy by contacting the data controller at the indicated email address.

11. ACCEPTANCE OF TERMS

11.1. Without prejudice to the provisions of Condition 8 and the rest of the conditions contained in these terms and conditions, participation in the promotion implies the express and unreserved acceptance of these terms and conditions.

11.2. Failure to comply with any of these rules by the participant will result in their immediate disqualification from the draw, and they will not be able to participate in the PROMOTION by any other means.

12. APPLICABLE LAW AND JURISDICTION

12.1. These Promotion Terms and Conditions are governed by Spanish law. The Courts of the city of Seville shall have jurisdiction to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfillment of these terms and conditions.

12.2. If any clause or part of a clause of these terms and conditions is declared null, illegal or unenforceable, such clause or part thereof shall be deemed not to have been included in these terms and conditions, without affecting the validity, legality or enforceability of the remaining conditions contained herein.
